Snow Plowing Liability
After spending several thousand dollars on your new plow, upfitting your
vehicle's suspension, electrical system, and tire chains, it is just logical
that now you want to turn these expenses into a paying investment. You have
plowed your driveway and even gotten paid for plowing your neighbor's driveway
and suddenly you see the extra income possibilities.
You talk to some of
your friends about your idea and the plot thickens. Friends are good about
bringing up all the problems and challenges to your ideas, aren't they? But, you
just found out how important it could be to have a good contract with with your
prospective clients, and this contract should be reviewed by a personal injury
lawyer and your insurance adjuster. When examining your liabilities in snow
plowing you will have to make some decisions. Are you also going to de-ice the
area you cleared? If so, you need more equipment and your overhead goes up. If
not, you should make sure that your contract includes disclaimers for snow or
ice left behind.
I'm sure your friends were also faithful to remind you
that your present vehicle insurance is probably not adequate for commercial snow
plowing. No, it probably is not, but it may be possible to add a rider to your
insurance policy for less than $1000.00 per year. If not, you may have to covert
your coverage to commercial coverage on your vehicle. It is debatable but
suggested by many that you also carry General Liability insurance. Since the
laws vary from state to state, you should know what the laws are in your area
and make sure you are covered. Of course, your fees for snow removal have just
gone up – welcome to the realities of doing business in these days when personal
injuries are seen like hitting the Lottery.
Whatever you do, you do not
want to risk everything you have or ever will have by not having adequate
insurance coverage and a comprehensive contract, signed by every client.
Nonetheless, having prepared, including those amber caution lights on your
vehicle if required, your dream of substantial extra winter income can become a
reality.
Happy Plowing.
